Effective August 1, 2025, Louisiana House Bill No. 178 amends LA CCP Article 3721, codifying existing procedures that govern foreclosure actions in Louisiana.
Procedural Impacts of Louisiana House Bill No. 178:
Under the new law, the seizing creditor must file an Affidavit of Payoff into the record immediately prior to the Sheriff’s sale. This affidavit must include the total indebtedness due under the note and mortgage through the sale date, including any advances for taxes, insurance, inspections, attorney fees, and similar charges.
Importantly, this change does not affect our firm’s existing foreclosure process. As part of our standard practice, our firm will continue to reach out to you before the scheduled sale date to obtain a full accounting of all amounts advanced on the loan. We will then ensure the Affidavit of Payoff is timely filed, enabling the Sheriff to proceed with preparing the property deed and disbursing sale proceeds.
